These Terms of Service (“Terms”) govern your use of the Hawaii Insurability Brief service operated by Ikena Design & Build LLC (“Company,” “we,” “us,” or “our”) at insurability.ikenagroup.com. By using this service or placing an order, you agree to these Terms.
What the Service Is
Hawaii Insurability Brief is a research service that compiles publicly available hazard and property data for Hawaii parcels into a single document. We query government GIS databases including USGS, FEMA, Hawaii Emergency Management Agency, Hawaii Wildfire Management Organization, ASCE wind speed maps, county permit records, and NOAA shoreline data, and deliver the results in a formatted research brief.
Hawaii Insurability Brief is not: an insurance policy, an insurance quote, an insurance inspection, a professional engineering assessment, a legal document, or a guarantee of insurability. We are not an insurance company, a licensed insurance broker, a licensed engineer, or a real estate professional.
The brief is a research document based on publicly available data. Its purpose is to help property owners, buyers, and brokers understand what government data sources say about a property's hazard profile. It does not determine your premium, guarantee coverage, substitute for a carrier's own underwriting, or replace any professional assessment required by a lender or insurer.
Accuracy and Limitations
We compile data from authoritative public sources and cite each source with a retrieval timestamp. However, we cannot guarantee the accuracy, completeness, or currency of data provided by third-party government agencies. Government databases have update cycles, known gaps, and occasional errors. Some data points — particularly roof age estimates derived from permit records — are estimates based on available permit data and may not reflect unpermitted work or unreported improvements.
If a data point cannot be retrieved for your parcel, the brief will indicate “not available — recommend on-site assessment” rather than providing an estimated or fabricated value. We do not guarantee that data will be available for every parcel.
You agree not to rely solely on this brief as the basis for a major financial decision. We encourage you to use the brief as a starting point for conversations with licensed insurance brokers, lenders, and inspectors who can conduct their own assessments.
Payment and Refunds
Payment is processed by Stripe at the time of order. The current price for a single Hawaii Insurability Brief is $19. Broker subscription pricing is listed on the broker page. All prices are in US dollars.
Refund policy: If you believe a data point in your brief is materially incorrect, contact us within 7 days of delivery at hello@ikenagroup.com. We will review the underlying source data and, if we find an error attributable to our compilation process, provide a full refund. We do not issue refunds because a carrier declined to write your property based on the data in the brief — the brief reports what the data says, not what you hoped it would say.
If your order cannot be completed (for example, if the property is outside Hawaii or the address cannot be matched to a parcel), we will issue a full refund within 5 business days.
Delivery
Briefs are delivered to the email address provided at order. Our target delivery time is within 60 minutes of payment confirmation during business hours. During our launch period, each brief is reviewed and sent by a human operator. Delivery times may be longer during periods of high volume or outside business hours. We will contact you if delivery will be delayed beyond 24 hours.
Account Terms
If you create an account, you are responsible for maintaining the security of your account. We use email-based magic link authentication; you are responsible for keeping your email account secure. You agree not to share your account credentials or use another person's account without permission.
Broker accounts include a monthly brief allowance. Unused briefs do not roll over to the following month. If you cancel a broker subscription, you will retain access through the end of the current billing period.
Prohibited Uses
You agree not to use the service to: (a) compile bulk property data through automated scraping or batch requests outside of the authorized broker CSV upload feature; (b) resell individual briefs without our written permission; (c) use the brief for purposes other than property risk research; (d) attempt to reverse-engineer or circumvent access controls.
Intellectual Property
The underlying hazard data in your brief is sourced from public government agencies and is not our proprietary property. The formatting, carrier-readable summary, and compilation methodology are proprietary to Ikena Design & Build LLC. You may share your individual brief with your broker, lender, or insurer for the purpose of obtaining insurance. You may not publish or resell the compiled brief without our written permission.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IKENA DESIGN & BUILD LLC AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR RELIANCE ON INFORMATION IN YOUR BRIEF, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE BRIEF OR SUBSCRIPTION GIVING RISE TO THE CLAIM.
Governing Law
These Terms are governed by the laws of the State of Hawaii, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Honolulu, Hawaii.
Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms with a revised effective date. Continued use of the service after changes constitutes acceptance of the updated Terms.
